Short-term home rentals: the tenant’s personal information must be sent to the police authorities within 24 hours

Decree-law October 4, 2018, no. 113 (published in the Gazzetta Ufficiale no. 231 on October 4, 2018, a.k.a. ‘Decreto Sicurezza’, converted into law on December 1, 2018, no. 132 ( published in the Gazzetta Ufficiale no. 281 on December 3, 2018,) established, under article 19bis n1, that landlords or sub-lessors of homes or parts thereof, even when the rental period is less than 30 days, must send to the competent (local) police authorities (Questura) the personal information of the people who are renting their property within 24 hours of their arrival.

In substance, those who let or sub-let a room in their apartment even if for a few nights only, have the obligation to communicate online the personal information of their (paying-)guests to the local police authorities within 24 hours of their arrival.

The personal information of the people being hosted must be transmitted online within 24 hours of their arrival to the local police authorities by means of the ‘Alloggiati Web’ system.

According to article 17, comma 1, of the Tulps, in the case of non-compliance, a sanction of up to three months arrest or a fine of €206 is foreseen n3.
